Let's accept that you are an owner of a real estate or that you have bought one and you want to build your own house. As such, you are an investor who will finance the building of the home. You have to know that the activity of the organization of the respective municipality (regions), according to the recently passed Territory Layout Law.
The building in the sense of the Territory Layout Law is the situating and building of edifices, structures, systems and equipment on land estates.
According to art. 5, par. 2 from the Territory Layout Law, the main architect of the municipality (region) makes and controls the actions of territory lay-out in accordance with its conceded capacities.
The first thing that you must provide is a plan (visa) for projection.
The demand for issuing of plan (visa) for projection is made by a written application from the person, who has a right to build in the real estate. In a 14-days term starting from the date of submitting the application, the main architect of the municipality (region) issues the plan (visa) for projection. The visa is a copy of the operative detailed layout plan with the specified location, way of building and purpose of the object and the necessary utmost limited indexes, sizes and distances of the building. What is included in the plan is: an architecture layout; ecological, infrastructural and other requirements for profit a water, electricity and other resources; the necessary documents, under art.144, par.1 from the Territory Layout Law, which must be presented by the investor for issuing of a build permission.
It follows the preparation of the working project. You can assign this problem to us - Bulgarian Real Estate Ltd. and to our partners - architectural designing bureaus and building companies.
The project must consist of an architectural part and other parts like: constructive, electric transmission line, water-conduit, sewerage, heating and ventilation. Each one of the parts must include explanatory notes, drafts and calculations.
The approval of the working project consists of approval of its architectural part from the main architect of the municipality after concordance with the other project parts from specialists of the city administration. The administrative agencies, the officials of which have the right according to the Territory Layout Law to accept the projects, to provide competent opinion about the requirements for:

  • saving of the nature for the buildings, for which is demanded an evaluation of the effect on the environment;
  • sanitary control, when this is demanded with a normative deed;
  • technical safety and reliability of the object to the state technical control equipments with an increased point of danger;
  • buildings in a landslide regions;
  • defined kinds of buildings, according to the normative deeds.
  • fire and breakdown security, when this is demanded with a normative deed;
  • If there are some breaches in the normative and deviations from the layout rules and normative, the project could be returned for remaking. Remade projects are approved in the same way. The approval or remaking is done in term of one month from the entrance date.
For the services of viewing and approval of the projects, the administrative officials charge fees according to the State Duty Law and the Local Taxations Law. After you complete:

  • documents for ownership;
  • plan (visa) for project;
  • the necessary permissions depending on the kind, specification and the situation of the building from the respective offices for use of drinking water, for use of electricity, for communication, for heating, gas, etc. which are required with a normative deed, are presented in an application for issuing of a permission for build ing .
The permission for building is issued in a 7-days term after the entrance of the written application. It is issued to the owner of real estate or to the person, who has the right for building in somebody else\'s real estate. In the building permission are written all actual and legal grounds for its issuing, the terms, relevant to the execution of the building. The building permission or its refusal could be in 14-days term from the notice of issuing of the respective deed.
To the building permission is also applied a certified copy from the approved project. The building permission loses its legal action when in a 3 - years term from its issuing the building has not been started or when in the course of 5 years from the issuing the rough work is not completed, including the roof of the building. This is specified in writ ten form by the official who has issued it.
The next stage is "BEGINNING OF THE BUILDING". For the beginning of the building is considered the day of consist of the report for opening of building site and determination of the building line and a level. This is made by a written application by the investor to the mayor of the municipality (region) according to the issued permission for building
Main participants in the building are the investor, the designer and the builder. Each of the main participants in the building process can perform the functions of the other main participants. Participants in the building are also and the building developer, the supplier, the qualified technician and the technical control person. The relations between the participants in the building are settled freely by contracts, by observing of the Territory Layout Law and of the other normative deeds. The guarantee period of building and assembly works should correspond to the project and the building rules and norms. When the building is completed, the investor and the builder prepare an Ascertain act which certifies that the building is made according to the executive documentation, the technical requirements for health and safety conditions of labour and the conditions under the concluded contract. The transfer of the building from the builder to the investor is made with this act. With the appropriate organization many of the above mentioned stages could be completed in much less time and your dream can come true only for a few months.
